1. Scope of Terms and Application<\/h4>\n

1.1.
\nSul sito internet www.free-time-activities.com (da qui chiamato \u201csito internet\u201d) di free-time-activities.com di Luca Lafranchi (da qui chiamato \u201cfree-time-activities.com\u201d), gli utilizzatori del sito internet possono prenotare corsi e attivit\u00e0 in barca a vela. <\/p>\n

\nLe prestazioni di free-time-activities.com si limitano al funzionamento del sito internet, alla pubblicazione delle attivit\u00e0, all\u2019accompagnamento e alla consulenza del visitatore per l\u2019organizzazione dell\u2019attivit\u00e0 desiderata fino allo svolgimento diretto della stessa (se non organizzato da un partner). <\/p>\n

\nNel caso l\u2019attivit\u00e0 fosse svolta da un partner, il ruolo di free-time-activities.com si limita a quella d\u2019intermediario tra il partecipante ed il partner (societ\u00e0, associazione o indipendente) che propone le attivit\u00e0 tramite il sito internet.
\nIn questo caso l\u2019acquisto di una prestazione avviene tramite contratto di vendita tra il partecipante ed il partner.

\nNel caso l\u2019attivit\u00e0 fosse svolta da free-time-activities.com, la quota richiesta serve per coprire i costi derivanti dall\u2019utilizzo della barca, l\u2019acquisto del materiale necessario alla navigazione come portolani e carte, al tempo necessario alla pianificazione, alle assicurazioni, etc. <\/p>\n

2. Prices<\/h4>\n

3. Payment Methods and Confirmation<\/h4>\n

3.1 The price of the activity includes the services as specified in each information sheet.
Payments must be made exclusively using one of the following methods:<\/p>\n

  • Bank Transfer<\/li>\n
  • Carta di credito<\/li>\n
  • TWINT<\/li>\n<\/ul>\n

    3.2 Upon booking, a deposit of 50% of the total amount must be paid, while the remaining balance must be settled 90 days before the start of the activity. If the registration is made less than 90 days before the start of the activity, the full amount due must be paid. Otherwise, the booking will not be considered valid, and the reserved spot will be released. <\/p>\n

    3.3 The price for all activities does not include travel, food, fuel costs, or harbor fees, unless otherwise specified in the course details. <\/p>\n

    4. Behavior Rules and Participant Obligations<\/h4>\n

    Each participant in the activity expressly agrees that the vessel will be placed under the command of a Captain or Instructor appointed by the organizer. The Captain or Instructor will have absolute responsibility on board in accordance with the safety and navigation regulations. <\/p>\n

    Participants must strictly adhere to the directives given by the Captain or Instructor and must always maintain respectful behavior towards other participants on board. Serious violations of the instructions given by the Captain or Instructor, or other behavioral shortcomings, may result in the participant being removed from the activity. The participant agrees to integrate into the community of the activity and to comply with the rules in effect as communicated in writing by the organizer or verbally by the Captain or Instructor: <\/p>\n

    • during the sailing, participants must observe the safety and navigation rules and follow all instructions given by the Captain or Instructor.<\/li>\n
    • Arrivals and departures must occur in accordance with the dates and times communicated to the participant before the start of the activity.<\/li>\n
    • order and cleanliness are essential on board. Each participant is required to ensure the hygiene and tidiness of their own person, their cabin, as well as the common areas and all the equipment on the boat where the activity takes place. Each participant will be asked to contribute to the cleaning, maintenance, and management of the boat according to the directives received from the Captain or Instructor. <\/li>\n
    • The use of violence (both verbal and physical) and other disrespectful, offensive, and socially unacceptable behavior will not be tolerated.<\/li>\n
    • the presence and use of illegal or immoral substances and\/or objects, such as weapons or drugs, are strictly prohibited during the activity. In the event of any violation of the aforementioned obligations or other actions contrary to the law and good conduct, participants may be excluded from the activity and will bear the costs of their return journey without any refund of the participation fee. <\/li>\n<\/ul>\n

      5. Right to Refund in Case of Cancellation<\/h4>\n

      5.1.
      \nLe rinunce dovranno essere comunicate per iscritto tramite lettera raccomandata o via e-mail. <\/p>\n

      5.2 Cancellation of the activity by the participant will result in the following:<\/p>\n

        \n
      • a full refund of the amount paid, provided the cancellation is received within 14 days from the confirmation of registration <\/li>\n
      • a 70% refund<\/span> of the amount paid, provided<\/span> the<\/span> cancellation is received at least 60 days before the start of the activity<\/span><\/li>\n
      • a 30% refund<\/span> of the amount paid, provided<\/span> the <\/span> cancellation is received between 59 and 31 days before the start of the activity<\/span><\/li>\n
      • No refund will be given for cancellations less than 30 days before the start of the activity <\/span> or for participants who leave the activity before the end of the program.<\/span> <\/li>\n<\/ul>\n

        5.3 If the participant does not adhere to the rules and their obligations, or is uncomfortable (e.g., significant conflicts with the Captain, Instructors, or other participants), the organizer reserves the right to terminate the activity for the participant. In such cases, the participant will be responsible for all repatriation costs, with no refund of the participation fee. In the event of repatriation, the Captain will not be required to alter the travel program for the participant’s disembarkation. <\/p>\n

        5.4 It is always allowed for a participant who cancels to transfer the reservation and credit to another person, provided that the new participant meets the necessary requirements to join the booked activity.<\/p>\n

        5.5 In the case of COVID-19, injury, or illness, a refund will be provided according to the conditions and times stated above.<\/p>\n

        5.6 For complete coverage, it is recommended to obtain private insurance to cover any cancellation costs and expenses.<\/p>\n

        6. Liability<\/h4>\n

        6.1.
        \nfree-time-activities.com \u00e8 esonerata da qualsiasi responsabilit\u00e0 per fatti, danni ed altro procurati dal partecipante a s\u00e9 stesso o a terzi, derivanti dalla partecipazione ai corsi di vela o altre attivit\u00e0, sia a terra che in acqua. <\/p>\n

        6.2.
        \nIl partecipante si assicura di avere la giusta copertura assicurativa per l\u2019attivit\u00e0 scelta. <\/p>\n

        6.3.
        \nIl partecipante dev\u2019essere capace di nuotare o comunque avere una buona familiarit\u00e0 con l\u2019acqua. <\/p>\n

        7. Photographic and\/or Video Rights:<\/h4>\n

        During the activities, free-time-activities.com, through its collaborators, intends to take photos or make videos to highlight and promote its activities. <\/p>\n

        Participants explicitly consent to free-time-activities.com to publish and\/or transmit, by any means, photographs or video footage taken during the activity, for the purpose of promoting the offerings of free-time-activities.com, including brochures, television commercials, online multimedia channels, social media, and other marketing channels. The handling of collected images will be carried out in compliance with the law. <\/p>\n

        8. Modifications to the Terms and Conditions<\/h4>\n

        free-time-activities.com may modify the Terms and Conditions at any time. The Terms and Conditions are available on the website or upon request via email.<\/p>\n

        9. 9. Applicable Law and Jurisdiction<\/h4>\n

        These terms are governed by Swiss law. The competent court is in Locarno. <\/p>\n

        8. Acceptance<\/h4>\n
